By securing a charter or utilizing our Service, you consent to be governed by these Terms. Should you not agree with any segment of these terms, you must not use the Service.
2. Service Overview
HarmoniousLivingIdeas offers exclusive yacht charter services, which include, but are not limited to:
- Daily yacht charters
- Sunset excursions
- Business outings
- Exclusive gatherings
- Extended charters
Our offerings are contingent on availability and meteorological conditions. We have the right to change or halt services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For a successful charter reservation, you are required to:
- Have a minimum age of 18 years
- Submit correct and comprehensive details
- Remit the specified deposit as stated in your reservation confirmation
- Commit to these Terms & Conditions
3.2 Confirmation
A reservation is only secure after the payment has been received and you've obtained our written confirmation. Service provision is at our sole discretion.
3.3 Availability
Charter availability is based on the vessels available and favorable weather conditions. We will endeavor to meet your requested dates and timings.
4. Payment Terms
4.1 Pricing
All fees are quoted in £ and encompass all applicable taxes unless indicated otherwise. Prices may vary without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the complete charter fee is payable upon reservation
- Final Payment: Due 48 hours prior to charter commencement
- Extra charges (if any): Payable at the charter's conclusion
4.3 Payment Methods
We accept commonly used credit cards, electronic fund transfers, and certified bank drafts. Payments are processed through secure, encrypted mechanisms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full refund less transaction fees
- 24-72 hours before departure: Refund of 50%
- Less than 24 hours before departure: No refund granted
5.2 Weather Cancellations
In the event that our captain deems the weather conditions unsafe, we will propose to:
- Arrange an alternative charter date without additional fees
- Issue a complete refund if rescheduling is not feasible
5.3 Vessel Malfunction
If your designated vessel experiences mechanical issues, we will try to arrange an appropriate replacement. If a substitution is not available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Protocols
All passengers are expected to:
- Obedience to all directives from the crew
- Use the safety equipment as mandated
- Disclose any health conditions that might affect onboard safety
- Stay within designated areas on board
6.2 Forbidden Items
The following items are not permitted aboard:
- Glassware
- Proscribed substances
- Weapons of any kind
- Pets (except with prior permission)
6.3 Behavior
Passengers should behave in a considerate and respectful manner. We retain the authority to end a charter prematurely without a refund if a passenger's behavior presents a safety hazard or disturbs other guests.
7. Liability and Insurance
7.1 Company Liability
Our responsibility is confined to the charges paid for your yacht reservation. We are not accountable for:
- Injuries that occur due to passenger carelessness
- Theft or impairment of personal belongings
- Indirect or punitive losses
- Delays stemming from environmental conditions or other factors beyond our governance
7.2 Insurance
We maintain extensive marine insurance for our fleet and activities. It's the passenger's duty to obtain their individual insurance coverage.
7.3 Acceptance of Risk
By joining our yacht services, you recognize that marine outings have inherent dangers and you accept accountability for your well-being.
8. Modifications to Itineraries
We hold the right to alter itineraries, paths, or timetables based on weather, safety requirements, or functional necessities. We shall try to deliver similar alternative experiences wherever possible.
9. Force Majeure
We are not responsible for hold-ups, cancellations, or the need to change details caused by events beyond our control, which include, but are not limited to:
- Extreme weather phenomena
- Natural catastrophes
- Government directives
- Harbour closures
- Equipment malfunctions
10. Privacy and Data Usage
Your private details are managed as per our Privacy Policy. By engaging with our service offerings, you agree to our collection and use of your data as outlined within our Privacy Policy.
11. Proprietary Rights
Material on our webpage, such as text, visuals, symbols, and photographs, is protected by copyright and trademarks. Unauthorized reproduction, distribution, or alteration is forbidden without express consent.
12. Governing Statutes
The governing regulations of United Kingdom control these Terms. Any legal disputes will be settled in the courts of Portsmouth, United Kingdom.
